Why Delaware? Delaware Ranks #1 in Lawsuit Climate Survey- again!

We are often asked "Why should I incorporate in Delaware?".

The truth is, there are many reasons why companies choose Delaware as their corporate home, and now those seeking the best jurisdiction for their company have yet another reason to consider the First State.

It was just announced that Delaware has been ranked #1 overall for best lawsuit climate in the United States for the 10th time in a row!

So what is all of that and why does it matter?

The 2015 Lawsuit Climate Survey: Ranking the States (PDF) was conducted for the U.S. Chamber Institute for Legal Reform to explore how fair and reasonable the states’ tort liability systems are perceived to be by U.S. businesses. Why does that matter? Simply put- perception is reality. These perceptions are undoubtedly considered by company boards, legal counsel, and executives when making business decisions about where to locate or expand. So much so that a full three quarters of the respondents in this survey (that's a whopping 75%!) report that a state’s litigation environment is likely to impact important business decisions at their companies such as where to conduct/expand/constrict business operations or sales.. This is a significant increase from 70% in 2012 and 67% in 2010. That is an 18 percent increase from eight years ago, and an all-time high.

Yes, the question "Why Delaware?" is a good one. Perhaps a better question to ask yourself is "Where does my state rank?" (Hint: it isn't at the top of the list!).
