U.S. Export Initiatives

  • Export Control Reform Initiative Home Page: The Administration has unveiled its home page for the Export Control Reform Initiative. Currently, key features of the website include: recent press releases, speeches and fact sheets, a "Progress Report" section containing notices of new and proposed rules for different trade-related agencies, and a consolidated version of the multiple screening lists maintained by several agencies.   • Strategic Trade Authorization License Exception: The Bureau of Industry and Security has proposed a new license exception to the Export Administration Regulations (EAR). The new exception would allow for the export, re-export and in-country transfer of certain specified items to low-risk destinations and end-users. Exports or transfers under this exception would require notification, destination control statements and consignee statements.   • Revisions to the Commerce Control List: The Bureau of Industry and Security is seeking public comments on a proposed rule that would change descriptions on the Commerce Control List to be "more clear and positive and 'tiered,' consistent with the Export Control Reform Initiative. Suggested comments include "the degree to which a controlled item provides the United States with a critical, substantial, or significant military or intelligence advantage; and the availability of the item outside certain groups of countries." The comment period for the proposed rule ends 02/07/2011.   • Proposed Revision to USML Category VII: The Department of State has proposed a rule to amend United States Munitions List (USML) Category VII, which includes tanks and military vehicles, to more precisely define the defense articles contained in that category.   • Notice of Proposed Rulemaking for Revisions to the USML: The Directorate of Defense Trade Controls (DDTC) is seeking public comment on proposed revisions to the USML. The DDTC is seeking public comment on "how the USML can be revised so that it clearly describes what is subject to the jurisdiction of the International Traffic in Arms Regulations (ITAR)," as well as comments on the tier-identification of defense articles and articles not falling within the scope of the tiers.
