Delaware Corporate Legislation Tracker

Stay on top of changes to the DGCL with the Delaware Corporate Legislation Tracker. This is a free service, designed to keep you informed on current and pending legislation related to Delaware Corporate rules and regulations. Here's what's been happening this past week:


The following Legislation affecting Title 9 - Counties was acted upon by the General Assembly on 5/11/2010:

SB 258
Title: AN ACT TO AMEND TITLE 9 OF THE DELAWARE CODE RELATING TO EXEMPTIONS FROM TAXATION FOR CERTAIN ORGANIZATIONS.



Synopsis:
This Act exempts from taxation by local government real property owned by the Hall Boards, Hall Corporations or Holding Companies of the Masonic Lodges in Delaware. All Lodges in Delaware are charitable organizations under federal law and raise funds for local and national charities. None of the property is held for investment purposes. Currently some Hall Boards of Masonic Lodges in Delaware are exempt from county property taxes. This will provide uniform treatment of these properties throughout the state.

The following Legislation affecting Title 12 - Decedents' Estates and Fiduciary Relations was acted upon by the General Assembly on 5/13/2010:

SB 272
Title: AN ACT TO AMEND CHAPTER 11 OF TITLE 12 OF THE DELAWARE CODE RELATING TO ESCHEATS.



Synopsis:
This Act improves the administration of the Delaware Abandoned and Unclaimed Property Statute by providing holders with additional clarity and certainty regarding the enforcement of the Delaware abandoned property statute.

Delaware courts strive to maintain preeminence

When you are at the top of your game, someone always wants to take your place. In Delaware, we say bring it on!

Delaware is always facing competition for corporate cases. As a result, Delaware courts evolve to meet litigants' needs and to maintain top marks in legal community.

Here's some recent examples:

In March, Chancery Court -- the nation's leading forum for business disputes -- set up new fast-track arbitration procedures in an effort to broaden its appeal and bolster Delaware's preeminence.

Last week, the state's Superior Court system -- which handles civil and criminal cases along with business lawsuits -- established a division designed specifically to give corporate litigants a more focused, predictable forum.
