The following Legislation affecting Title 6 - Commerce and Trade was acted upon by the General Assembly on 1/16/2013:




HB 8
Title:  AN ACT TO AMEND TITLE 6 OF THE DELAWARE CODE RELATING TO THE UNIFORM COMMERCIAL CODE.


Synopsis:

It is the purpose of this Act to amend Article 9 of the Delaware Uniform Commercial Code dealing with secured transactions. The revisions to Article 9 are part of a national effort led by the National Conference of Commissioners on Uniform State Laws and The American Law Institute that seeks adoption of revisions in substantially the form proposed by all applicable states within, or other jurisdictions under the control of, the United States.

HB 19
Title:  AN ACT TO AMEND TITLE 6 OF THE DELAWARE CODE RELATING TO THE PARTNERSHIP AND ASSOCIATION DOCKET FEE FOR FILING CERTIFICATE.


Synopsis:

This bill modifies the Prothonotary’s fee for filing a certification registering a trade name to make it consistent with the fee as set forth in Superior Court Civil Rule 77(h)F which is currently $25.00. The fee of $5.00 was set in 1980. In addition, this bill deletes the reference to recording the filing of the certificate in a “book.” The filing of a trade name or fictitious name certificate is docketed and recorded in a database.

The following Legislation affecting Title 19 - Labor was acted upon by the General Assembly on 1/15/2013:




SB 6
Title:  AN ACT TO AMEND TITLE 19 OF THE DELAWARE CODE RELATING TO THE MINIMUM WAGE.


Synopsis:

This Act would increase the minimum wage to not less than $8.00 per hour effective July 1, 2013, and not less than $8.75 per hour effective July 1, 2014. If the federal minimum wage becomes higher than the Delaware minimum wage, the Delaware minimum wage would increase by $1.00 above the federal minimum wage. In addition, effective July 1, 2014, the minimum wage would increase by a percentage equal to the percentage of Cost of Living Adjustment (COLA) as determined periodically under the federal Social Security Act, with the increase in the hourly rate being effective 90 days after the effective date of the corresponding increase in federal Social Security benefits.
