Post Trial Findings from Delaware Court in Intellectual Property Case

If you can't beat them, rip them off?

For those of you who are keeping up on intellectual property and copyright cases in our area, the U.S. District Court for the District of Delaware recently awarded $25,000 in statutory damages in favor of Webloyalty.com, Inc. for the willful infringement of copyright work by Consumer Innovations, LLC.

Here's the recap:

Webloyalty.com Inc. charged that Consumer Innovations LLC, a rival Web promotions firm, copied its banner ad and other promotional material taken from a related Web page and used the material to create a virtually identical promotions package.

The case is Webloyalty.com, Inc. v. Consumer Innovations, LLC (DeFAX Case No. D62182).

According to LexisNexis, the court also awarded a total of $226,611.75 in attorney fees to Webloyalty.com, Inc. after a summary judgment motion by Consumer Innovations, LLC was denied.
